Embarking on a groundbreaking initiative, Brazil launches Public Consultation No. 44 to redefine the technical and operational prerequisites for utilizing frequency bands associated with the private limited service via terrestrial systems. This forward-looking endeavor aims to enhance efficiency, foster innovation, and ensure seamless communication across fixed and mobile services.

In a decisive move, several outdated acts, including Act No. 6.053, Act No. 4.800, Act No. 3.037, Act No. 1.132, Act No. 8.991, Act No. 8995, and Act No. 14.452, are slated for revocation, paving the way for a comprehensive regulatory framework tailored to modern needs.

Through this consultation, Brazil seeks to redefine channelization parameters, operating limits, and usage conditions across a wide array of frequency bands. From the 2 MHz to 90 GHz range, the consultation sets forth stringent standards, ensuring optimal spectrum utilization while accommodating advancements in digital radio technology.

Crucially, the consultation’s final and transitional provisions underscore Brazil’s commitment to a smooth transition. Existing systems are granted a grace period until September 7, 2028, to align with the updated requirements, ensuring continuity of service without causing harmful interference.

Impacting type approval processes with power limit testing requirements and suggesting spectrum limits for digital radio bands, this consultation signals Brazil’s proactive stance in fostering technological innovation while upholding regulatory standards.

With stakeholders invited to contribute until September 28th, 2023, this consultation presents a pivotal opportunity to shape the future of digital radio communications in Brazil. Embracing the spirit of progress, Brazil stands poised to usher in a new era of connectivity and efficiency in radio spectrum management.
