On January 24, 2023, the FCC unveiled KDB 986446, offering essential guidance to protect against equipment posing risks to national security or the safety of U.S. citizens. With the adoption of rules prohibiting authorization for such equipment, effective immediately upon publication in the Federal Register on February 6, 2023, there’s no transition period – action is imperative.

Here’s what you need to know:

1. Attestation Statements:All FCC Equipment Authorizations granted by TCBs must now include two crucial attestation letters. Firstly, the Attestation Statements US agent, signed by both the Applicant and the US agent, affirming acceptance and acknowledgment of the application’s obligations. Secondly, the FCC Covered Equipment Certification Attestation Letter, signed by the Applicant, certifies that the equipment is not “covered” and that the applicant is not on the Covered List.

2. Covered List:The Covered List, accessible via www.fcc.gov/supplychain/coveredlist, outlines entities whose equipment is prohibited from authorization. This includes Huawei, ZTE, Hytera, Hikvision, Dahua, and their subsidiaries and affiliates.

3. US Agent Responsibilities:For non-U.S.-based applicants, a US Agent for Service of Process is required. This entity, whether an individual or a company, must meet specific criteria akin to the US responsible party for SDoC.

4. Who Can Be a US Agent:The US Agent can be the U.S.-based manufacturer, assembler (if the equipment is assembled from component parts), or importer (if the equipment is imported).
