Published on November 27th, 2023, ANATEL Act No. 16539 heralds a new era in the regulation of radio frequency bands associated with services of collective interest. This landmark legislation replaces several outdated acts, modernizing and refining technical and operational requirements across various frequency bands.

Among the key highlights of this comprehensive act are:

400 MHz Band:

  • Introduction of power limits and tailored operating conditions for Point-to-Point (PtP) and Point-to-Multipoint (PmP) applications.

450 MHz Band:

  • Clear delineation of power limits alongside additional operational specifications.

700 MHz Band:

  • Specification of power limits, emission limits, and operational guidelines, including innovative band-sharing arrangements between Radiocommunications and TV broadcasting.

800 MHz Band:

  • Defined power limits accompanied by supplementary operational directives.

900 MHz Band:

  • Establishment of power limits and operational parameters to ensure efficient usage.

1.710 MHz to 1.880 MHz Sub-Band:

  • Specification of power limits and tailored operational guidelines.

1.880 MHz to 1.885 MHz and 1.910 MHz to 1.920 MHz Sub-Bands:

  • Definition of power limits alongside detailed operational requirements.

1.900 MHz and 2.100 MHz Bands:

  • Introduction of power limits and operational specifications to optimize band usage.

2.300 MHz to 2.390 MHz Sub-Band:

  • Clear delineation of power limits and emission limits to ensure compliance.

2.500 MHz to 2.690 MHz Sub-Band:

  • Establishment of power limits, emission limits, and additional operational conditions.

2.570 MHz to 2.618 MHz Sub-Band:

  • Specification of power limits alongside nuanced operational directives.

3.300 MHz to 3.700 MHz Sub-Band:

  • Introduction of power limits, emission limits, and stringent operational guidelines.

24.25 GHz to 27.5 GHz Sub-Band:

  • Specification of power limits and emission limits, with a focus on mitigating satellite interference.

39.5 GHz to 40 GHz Sub-Band:

  • Clear delineation of power limits and emission limits to uphold regulatory standards.

This act significantly impacts type approval and market access requirements, as well as spectrum allocation. However, imports remain unaffected by these transformative changes.

ANATEL Act No. 16539 underscores Brazil’s commitment to fostering innovation, efficiency, and responsible spectrum usage, thereby paving the way for enhanced telecommunications services and collective benefit for society.
