The Instituto Federal de Telecomunicaciones (IFETEL) opened a public consultation on November 13, 2023, regarding the Preliminary Draft Agreement that modifies the Guidelines for granting Certificates of Authorization (CoA) for secondary use of frequency bands. The draft includes the following proposals:
- A recommendation by the 5G Committee to extend the authorization validity under the Guidelines for Secondary Use up to 20 years.
- Providing legal certainty to authorized parties when requesting extensions, ensuring the Guidelines allow the authorization period to be extended for a duration equal to or longer than the original validity.
- Establishing a 60-business-day deadline for submitting CoA requests prior to the specific event or start of frequency operations.
- Extending CoA validity for secondary use of facilities intended for industrial or commercial activities to 7 years.
- Considering technical information from experimental concessions in the evaluation of CoA requests.
- Addressing provisions for extending or modifying the CoA for secondary use.
